Company: Nurturing Nanny LLC

Customer: The Family

Service provider: The Nanny

Purchase order: Service Agreement

1. SERVICE

a. Upon Family's request, Nurturing Nanny will arrange for a partnership between the Nanny and Family subject to these TERMS. Nurturing Nanny reserves the right, in its sole discretion, to refuse or cancel any inquiry, service, and/or agreement at any time.

b. Nurturing Nanny does not employ any caregiver and is not responsible for the conduct of any Family or Nanny. You need to do your own diligence to ensure the Family or Nanny  you choose is appropriate for your needs and complies with applicable laws.

c. Nurturing Nanny's services are deemed completed when the Family decides to hire and or keep the Nanny.

2. THE FAMILIES RESPONSIBILITIES

a. Accuracy of information: The Family understands and accepts that only the Family is responsible to ensure the accuracy of all of the details including the schedule, number of children, and compensation for the Nanny. 

b. The Family agrees to pay Nurturing Nanny the agreed upon total fees as listed in the Service Agreement once the Service is completed.

c. The family agrees that if a Nanny is hired, they will be paid legally on a W2 as a household employee.

c. The Family agrees that any member of their household has never been:

• the subject of a conviction, arrest, charge, complaint, restraining order or any other legal action involving:
  • any felony;
  • any other criminal offense involving violence, physical, sexual, or emotional abuse or neglect, or theft, drugs, or
  • any offense, violation, or unlawful act that involves endangering the safety of others, fraud, dishonesty, or reckless or negligent conduct.

d. If the family fails to respond to Nurturing Nanny for an entire week (7 calendar days) after booking the service, the service is then no longer required. The customer must inquire for a new quote and book a new service.

3. THE NANNY'S RESPONSIBILITIES

a. Accuracy of information: The Nanny understands and accepts that only the Nanny is responsible to ensure the accuracy of the details including the resume, referrals, availability, number of kids you are able to accommodate, and required compensation.

b. The Nanny is not hired as an independent contractor or an employee by Nurturing Nanny. The Family will make the final decision on hiring or keeping the Nanny.

c. The Nanny agrees that they have never been:

• the subject of a conviction, arrest, charge, complaint, restraining order or any other legal action involving:
  • any felony;
  • any other criminal offense involving violence, physical, sexual, or emotional abuse or neglect, or theft, drugs, or
  • any offense, violation, or unlawful act that involves endangering the safety of others, fraud, dishonesty, or reckless or negligent conduct.

4. BACKGROUND CHECKS

a. Nurturing Nanny will conduct the initial background check via Checkr. Please refer to their Terms of Service. Nurturing Nanny does not take any responsibility from the information or result of this background check.

b. It is up to the Family to conduct their own diligence when it comes to hiring or keeping the Nanny.

5.1 PAYMENT AND FEES

a. The Family agrees to pay Nurturing Nanny all total payments as stated in the Service Agreement. 

b. The Family agrees to pay Nurturing Nanny all Initial Deposits/Search Fee of as stated in the Service Agreement. All Initial Deposits/Search Fees are non-refundable.

c. The Family agrees to pay Nurturing Nanny the Final Payment as stated in the Service Agreement on the date service is completed.

5.2 PRICE MATCH

a. Nurturing Nanny will price match a valid competitor quote up to 75%. Nurturing Nanny has the right to refuse a price match if the quote is considered invalid. 

6. NANNY PAY REQUIREMENT

Nurturing Nanny recommends a minimum of $25/hour or higher, depending on the Nanny's experience level and the job requirements. . Nurturing Nanny does not guaranteed any pay rates or compensation. The pay rate is only decided by and confirmed between the Family and the Nanny during the interview and hiring process.

7. TRIAL PERIOD

The Family understands that once the Nanny has been placed, a 30-day trial period will be initiated from that day. Within this period, the Family has the option to use their request for a free replacement Nanny. If it is past 30-days, we will apply a 75% discount on a Nanny Placement. If it is past 60-days, there are no compensations or discounts. This is a one time use policy only.

8. RESUME BUILDER SERVICE

The invoice must be paid to Nurturing Nanny upon approval of the final draft of the resume. Once the invoice has been paid, Nurturing Nanny will provide a downloadable .pdf format of the resume.

9. INTERVIEW TRAINING SERVICE 

The invoice of $75 must be paid to Nurturing Nanny as agreed upon prior to the interview training meeting. 

10.1 DISCLAIMERS

While Nurturing Nanny takes certain steps to help promote the safety of our Site and Service, finding Nannies or Nanny-related jobs via an online platform like ours comes with certain inherent risks. We do not provide any training, supervision, or monitoring of Nanny Seekers or the Nannies, and we cannot guarantee that all of your interactions with other their families, or others associated with them, will always be 100% safe and respectful. You agree to assume all risks when using the Site and the Services, including but not limited to injury, illness, death, and all other risks associated with any online or offline interactions with users of the Site or the Services. You also agree not to rely solely on steps Nurturing Nanny may take to vet or screen Nannies  or Families and/or their Content, or otherwise to promote the safety of the Site and Services. You further agree to take all necessary precautions.

10.2 FAMILY RESOURCES DISCLAIMERS

Nurturing Nanny is not affiliated with any services listed under Family Resources. These services are purely for reference in need of the client or family. Nurturing Nanny does not require the client or family to use the service. It is completely up to the client or family to use the services listed. 

11. NANNY APPLICATION DISCLAIMER

1. Application Process: By submitting an application through this website, you acknowledge that you are applying to be considered for a nanny position with Nurturing Nanny. This application does not guarantee employment or an interview, and it does not establish an employer-employee relationship with Nurturing Nanny at this stage.
2. Information Accuracy: You understand and agree that all the information provided in the application is accurate and complete to the best of your knowledge. Any false or misleading information may result in the rejection of your application or, if employed, termination of employment.
3. Background Checks: As part of our rigorous screening process, Nurturing Nanny conducts background checks on potential nanny candidates. By submitting this application, you authorize Nurturing Nanny to conduct necessary background checks, including but not limited to criminal records, employment history verification, and reference checks.
4. Privacy and Data Protection: Nurturing Nanny takes your privacy seriously and adheres to applicable data protection laws. However, please note that the security of information transmitted over the internet cannot be guaranteed. You understand and agree that Nurturing Nanny is not responsible for any unauthorized access or interception of your personal information submitted through this application.
5. Application Review: Nurturing Nanny reserves the right to review, assess, and process applications based on its internal criteria and requirements. While we strive to review applications promptly, we do not guarantee a specific timeline for response or notification.
6. Communication: By submitting this application, you consent to receive communication from Nurturing Nanny regarding your application status and, if applicable, further steps in the hiring process via email, phone, or other means of communication provided.
7. Changes to Application Process: Nurturing Nanny reserves the right to modify, suspend, or terminate the application process at any time, with or without prior notice. We may also update the terms of this disclaimer, and it is your responsibility to review it periodically for any changes.

12. COPYRIGHT COMPLAINTS

It is Nurturing Nanny's policy to respond to notices of alleged copyright infringement with the Digital Millennium Copyright Act (“DMCA”). If you believe any materials accessible on or from our Site infringe your copyright, you may request removal of those materials (or access thereto) from the Site by contacting Nurturing Nanny and providing the following information:

1. Identification of the copyrighted work that you believe to be infringed. Please describe the work, and where possible include a copy or the location (e.g., URL) of an authorized version of the work.
2. Identification of the material that you believe to be infringing and its location. Please describe the material and provide us with its URL or any other pertinent information that will allow us to locate the material.
3. Your name, address, telephone number and (if available) e-mail address.
4. A statement that you have a good faith belief that the complained of use of the materials is not authorized by the copyright owner, its agent, or the law.
5. A statement that the information that you have supplied is accurate, and indicating that “under penalty of perjury,” you are the copyright owner or are authorized to act on the copyright owner’s behalf.

13. ARBITRATION 

Nurturing Nanny is always interested in resolving disputes amicably and efficiently. So before you commence arbitration, we suggest that you contact us to explain your complaint, as we may be able to resolve it without the need for arbitration.

If we cannot resolve a Claim informally, any Claim either of us asserts will be resolved only by binding arbitration and not in courts of general jurisdiction. Arbitration will be conducted by a neutral arbitrator in accordance with the rules of JAMS that are in effect at the time the arbitration is initiated (collectively referred to as the “JAMS Rules”), as modified by this Arbitration Agreement, and excluding the JAMS Class Action Procedures. 15. ACCEPTANCE OF AND MODIFICATIONS TO THESE TERMS

We assume that all Users have read this document and agree to its content. If you do not agree with these Terms, you must refrain from using our Sites and Services.

You acknowledge that you have carefully assessed the possible risks arising from Terms and you accept those risks.

These Terms may change from time to time. If we modify our Terms, we will notify you and post the revised statement here, with an updated revision date. If you do not agree to any changes to these Terms of Use after receipt of notice, you must discontinue your use of the Sites or Services.
